There are many different ways that you can use our services – to search for and share information, to communicate with other people or to create new content. When you share information with us, for example by creating a 3E Exchange (formerly Toxnot) Account, we can make those services even better – to show you more relevant search results, create better product design tools and to make sharing chemicals data easier and more secure. As you use our services, we want you to be clear how we’re using information and the ways in which you can protect your privacy.

3E Exchange (formerly Toxnot) understands that Users may disclose business, technical or financial information relating to the User’s business (hereinafter referred to as “Proprietary Information” of the User). Proprietary Information of 3E Exchange (formerly Toxnot PBC) includes non-public information regarding features, functionality and performance of the Service. Proprietary Information of Users includes non-public data provided by Users to 3E Exchange (formerly Toxnot PBC) to enable the provision of the Services (“Users Data”). 3E Exchange (formerly Toxnot) agrees: (i) to take reasonable precautions to protect such Proprietary Information, and (ii) not to use (except in performance of the Services or as otherwise permitted herein) or divulge to any third person any such Proprietary Information. The User agrees that the foregoing shall not apply with respect to any information that 3E Exchange (formerly Toxnot) can document (a) is or becomes generally available to the public, or (b) was in its possession or known by it prior to receipt from the User, or (c) was rightfully disclosed to it without restriction by a third party, or (d) was independently developed without use of any Proprietary Information of the User or (e) is required to be disclosed by law.
Users shall own all right, title and interest in and to the Users Data, as well as any data derived exclusively from the Users Data and provided to Users as part of the Services. 3E Exchange (formerly Toxnot PBC) shall own and retain all right, title and interest in and to (a) the Services and Software, all improvements, enhancements or modifications thereto, (b) any software, applications, inventions or other technology developed in connection with Implementation Services or support, and (c) all intellectual property rights related to any of the foregoing.
Users shall be solely responsible for any disclosures of Proprietary Information through 3E Exchange (formerly Toxnot PBC) Services, including but not limited to, responses to supplier surveys from other parties using the 3E Exchange (formerly Toxnot PBC) Services and granting account access to additional users.
Notwithstanding anything to the contrary, 3E Exchange (formerly Toxnot) shall have the right collect and analyze data and other information relating to the provision, use and performance of various aspects of the Services and related systems and technologies (including, without limitation, information concerning Users Data and data derived therefrom), and 3E Exchange (formerly Toxnot PBC) will be free (during and after the term hereof) to use such information and data to (i) improve and enhance the Services and for other development, diagnostic and corrective purposes in connection with the Services and other 3E Exchange (formerly Toxnot PBC) offerings, and (ii) aggregate with other data for the purposes of generating and disclosing de-identified statistics. No rights or licenses are granted except as expressly set forth herein.

Use of Intercom Services: We use third-party analytics services to help understand your usage of our services. In particular, we provide a limited amount of your information (such as your email address and sign-up date) to Intercom, Inc. (“Intercom”) and utilize Intercom to collect data for analytics purposes when you visit our website or use our product. Intercom analyzes your use of our website and/or product and tracks our relationship so that we can improve our service to you. We may also use Intercom as a medium for communications, either through email, or through messages within our product(s). Third-Party Payment Services: We use a third party payment processor to process payments made to us. In connection with the processing of such payments, we do not retain any personally identifiable information or any financial information such as credit card numbers. Rather, all such information is provided directly to our third party processor, Stripe, whose use of your personal information is governed by their privacy policy, which may be viewed at https://stripe.com/us/privacy.
Information we collect when you are signed in to 3E Exchange (formerly Toxnot), in addition to information we obtain about you from partners, may be associated with your 3E Exchange (formerly Toxnot) Account. When information is associated with your 3E Exchange (formerly Toxnot) Account, we treat it as personal information. We use the information we collect from all of our services to provide, maintain, protect and improve them, to develop new ones and to protect 3E Exchange (formerly Toxnot) and our users. We also use this information to offer you tailored content – like giving you more relevant search results and ads.
3E Exchange (formerly Toxnot) processes personal information on our servers in many countries around the world. We may process your personal information on a server located outside the country where you live.

We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup systems).
Where we can provide information access and correction, we will do so free of charge, except where it would require a disproportionate effort. We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from our services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.

If 3E Exchange (formerly Toxnot) is involved in a merger, acquisition or asset sale, we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.
We work hard to protect 3E Exchange (formerly Toxnot) and our users from unauthorised access to or unauthorised alteration, disclosure or destruction of information that we hold. In particular:
When a Google account is connected, the data we access and use is only used so the surveys you send are from your email. We store the associated email address with the account, and do not share that email address or any Google user data outside of 3E Exchange (formerly Toxnot). You can disconnect your account at any time, at which point we will stop storing the associated email address.
Our Privacy Policy applies to all of the services offered by 3E Exchange (formerly Toxnot PBC) and its affiliates, but excludes services that have separate privacy policies that do not incorporate this Privacy Policy.
Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you in search results, sites that may include 3E Exchange (formerly Toxnot) services or other sites linked from our services. Our Privacy Policy does not cover the information practices of other companies and organisations that advertise our services and that may use cookies, pixel tags and other technologies to serve and offer relevant ads.
Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes).
